منظمة تواصل لحقوق الإنسان Issues a Human Rights Memorandum on the Protection of the Right to Peaceful Assembly and Policing of Protests in Europe

منظمة تواصل لحقوق الإنسان announces the publication of its human rights memorandum entitled:

“Protecting the Right to Peaceful Assembly: An Assessment of Legal Standards and Law Enforcement Practices in Selected European Countries.”

The memorandum examines the international and European frameworks safeguarding the rights to peaceful assembly and freedom of expression. It also addresses the legal standards governing police conduct during demonstrations and public gatherings, through a comparative examination of legislation and practices in five European countries: the United Kingdom, France, Germany, the Netherlands, and Portugal.

The memorandum addresses a number of key human rights issues, including:

Standards governing police conduct during public assemblies.

Legal safeguards governing the use of force, including the principles of necessity and proportionality.

Mass arrests and their potential chilling effect on the exercise of fundamental rights and freedoms.

Protection of journalists, observers, and human rights defenders covering protests.

Safeguards for the protection of minors participating in demonstrations.

Emergency orders and exceptional restrictions, and their impact on the exercise of fundamental rights.

A comparative assessment of the legal frameworks and practices in the countries examined.

The memorandum is based on an examination and analysis of international and European legal frameworks, national legislation, official documents, and relevant published sources. Its purpose is to assess the extent to which the laws and practices examined are consistent with international and European human rights standards, while distinguishing between legal provisions, publicly documented facts, and the Organization’s human rights analysis.

The memorandum also sets out a series of recommendations and requests addressed to European institutions and relevant human rights bodies, with the aim of strengthening safeguards for peaceful assembly, promoting accountability, protecting individuals against disproportionate law enforcement interventions, and safeguarding freedom of expression, journalistic activity, and fundamental rights.

منظمة تواصل لحقوق الإنسان emphasizes that the protection of public order and respect for fundamental rights and freedoms must go hand in hand. The right to peaceful assembly remains an essential component of democratic societies and the rule of law.

📄 The full human rights memorandum is available on the Organization’s official website.
